Filmy - Terms and Conditions (AGB)

1. Eligibility

Filmmakers must be at least 18 years old and legally capable of entering into a binding agreement.

2. Ownership of Content

You may upload only films and related materials that you own or are legally authorized to distribute and monetize.

By uploading content, you represent and warrant that:

• You own or control all copyrights necessary to publish and sell the film.
• All music, footage, images, trademarks, and other third-party materials are properly licensed.
• All required permissions, releases, and consents have been obtained.
• Your content does not infringe the rights of any third party.

Ownership of your film always remains with you.

3. Creator Responsibility

Filmmakers are solely responsible for the legality of their uploaded content.

Filmy does not verify ownership of every uploaded film and relies on the creator's representations.

Uploading false, unauthorized, or infringing content may result in:

• immediate removal of the film;
• suspension or permanent termination of the account;
• withholding of future payouts where legally permitted;
• legal action where appropriate.

4. Prohibited Content

The following content is prohibited:

• Copyright-infringing material
• Pirated films or television content
• Unauthorized music or footage
• Child exploitation material
• Pornographic or sexually exploitative content
• Terrorist or extremist material
• Hate speech
• Fraudulent or deceptive content
• Malware or malicious software
• Content promoting illegal activities
• Any content violating applicable law

Filmy reserves the right to remove content at its sole discretion.

5. License Granted to Filmy

By uploading a film, you grant Filmy a non-exclusive, worldwide license to:

• host your content;
• encode and stream your film;
• display promotional artwork and trailers;
• process purchases;
• deliver streams to customers;
• promote your film on the Platform.

This license exists solely for operating the service.

All copyrights and ownership remain with the filmmaker.

6. Copyright Complaints

If Filmy receives a valid copyright complaint, the affected content may be removed or disabled without prior notice while the claim is investigated.

Repeat copyright offenders may have their accounts permanently terminated.

7. Payments to Filmmakers

Payments are processed through Stripe Connect.

When a customer successfully purchases access to a film, the filmmaker's share of the transaction is transferred automatically through Stripe, subject to Stripe's processing, verification, fraud prevention, and compliance procedures.

Filmy does not hold creator earnings unless required for legal, fraud, or compliance reasons.

Creators are responsible for all applicable taxes on their earnings.

8. Purchasing Access

A purchase grants access to one specific film only.

No ownership of the film or its intellectual property is transferred.

The purchase provides a personal, non-transferable, non-exclusive license to stream the selected film.

9. Access Codes

Each purchase generates a unique access code.

The code:

• is linked to the purchaser's registered email address;
• may only be redeemed by that account;
• is valid for 30 days from the date of purchase.

Unused access codes automatically expire after 30 days.

Expired codes cannot be restored.

10. Viewing Period

Each purchase grants access to one specific, unchanging film.

Once the access code is redeemed and playback begins:

• the viewing window lasts for 24 hours;
• during those 24 hours, the film may be started or replayed up to 10 times;
• after either the 24-hour period expires or the tenth playback has begun, access automatically ends.

Access begins when streaming is started for the first time.

11. Right of Withdrawal for Digital Content

Consumers generally have a statutory 14-day right of withdrawal under applicable EU consumer protection law.

However, this right expires once streaming of the purchased film has begun, provided the customer:

• expressly requested immediate access before the withdrawal period ended; and
• acknowledged during checkout that beginning the stream results in the loss of the statutory right of withdrawal.

No refunds will be issued after streaming has begun except where required by applicable law.

12. Streaming Restrictions

Purchased films are intended for personal viewing only.

Customers may not:

• download the film unless expressly permitted;
• copy, record, redistribute, broadcast, or publicly perform the content;
• share access codes or accounts with others;
• attempt to bypass technical protection measures.

Filmy may suspend accounts involved in abuse or unauthorized sharing.

13. Platform Scope

Filmy provides access to films published and licensed by independent filmmakers.

Film descriptions, pricing, availability, age ratings, and other relevant information are displayed on each film's page before purchase.

Filmy acts as a digital marketplace and streaming platform connecting filmmakers with viewers.

14. Platform Availability

While Filmy aims to provide uninterrupted service, availability cannot be guaranteed.

Temporary interruptions may occur due to maintenance, technical issues, payment provider outages, or circumstances beyond Filmy's reasonable control.

15. Intellectual Property

All platform software, technology, user interface, branding, trademarks, logos, and the name Filmyare the exclusive property of Filmy.

Nothing in these Terms transfers ownership of any filmmaker's intellectual property or grants any rights beyond the limited viewing license purchased by customers.

16. Limitation of Liability

Filmy provides hosting, payment facilitation, and streaming services for independently uploaded films.

To the fullest extent permitted by law, Filmy shall not be liable for damages arising from user-uploaded content or for indirect or consequential losses resulting from the use of the Platform.

17. Account Suspension

Filmy may suspend or terminate accounts that:

• upload infringing content;
• engage in fraud or payment abuse;
• violate these Terms;
• attempt to manipulate purchases or platform functionality;
• engage in illegal activities.

18. Changes to these Terms

Filmy may update these Terms from time to time.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Filmy is established.

Mandatory consumer protection laws applicable to the customer's country of residence remain unaffected.
